Terms of Service

These terms govern your use of MOBA (Motor Breakdown Assistance), operated by M&M Group of Companies. By booking a service or buying a membership you agree to these terms.

1. The service

MOBA dispatches trained responders to provide roadside assistance, including jumpstart, tyre change, fuel delivery, towing, lockout rescue and mobile mechanic services within Lagos metro and select partner regions. Service is offered 24 hours a day, 365 days a year, subject to traffic, weather and force majeure conditions outside our reasonable control.

2. Eligibility

You must be 18 or older, hold a valid Nigerian driver licence where applicable, and be the registered owner or lawful operator of the vehicle for which you request assistance.

3. Pricing and payment

Pay per use prices are shown in app before you confirm a booking. Membership prices are listed on the Membership page and renew annually unless cancelled. All payments are processed through Paystack in Nigerian Naira. Prices include VAT where applicable.

4. Member callouts

Each plan includes a set number of free callouts per membership year. Callouts beyond the included number are charged at the member discounted rate. Unused callouts do not roll over.

5. Response times

We aim for an average response of 30 minutes inside Lagos metro. This is a target, not a guarantee. Actual times depend on traffic, weather, time of day and the nature of the breakdown.

6. Your responsibilities

You agree to provide accurate location and vehicle information, remain at the scene unless safety requires otherwise, follow reasonable safety instructions from our responder, and pay all confirmed charges promptly.

7. Limitations of liability

MOBA is liable for direct damage caused by our gross negligence up to the value of the relevant service or annual membership fee, whichever is higher. We are not liable for indirect, consequential or punitive damages, loss of profits, or pre existing vehicle conditions. Nothing in these terms excludes liability that cannot be excluded under Nigerian law.

8. Insurance and damage

Our responders carry public liability insurance. If you believe a MOBA responder caused damage to your vehicle during a job, report it to help@moba.ng within 48 hours with photos and timestamp so we can investigate fairly.

9. Service refusal

We may refuse or terminate service if a scene is unsafe, if the vehicle requires equipment we do not carry, if a member is abusive to staff, or if payment cannot be confirmed.

10. Intellectual property

The MOBA name, logo, website, and content are owned by M&M Group of Companies. You may not copy or reuse them without written permission.

11. Governing law

These terms are governed by the laws of the Federal Republic of Nigeria. Disputes are subject to the exclusive jurisdiction of the courts of Lagos State.

12. Changes to these terms

We may revise these terms from time to time. Material changes will be communicated to active members by email at least 14 days before they take effect.
